Terms & Conditions

1. About These Terms

These Terms & Conditions govern access to and use of the Mason’s Vision website, the purchase of jewellery through our online store, and any bespoke or personalised jewellery commissions accepted by us.

By placing an order, you acknowledge that you have had the opportunity to review these Terms & Conditions before entering into a purchase contract.

These Terms & Conditions should be read together with our Privacy Policy, applicable delivery information, and any product-specific terms or written quotation provided to you.

If a specific written quotation expressly establishes different terms for a bespoke commission, those terms apply to that commission to the extent that they are consistent with applicable law. Mandatory consumer rights are not excluded or restricted by these Terms & Conditions.

2. Who We Are

The website is operated by:

Legal name: Mason’s Vision EOOD
Country of registration: Republic of Bulgaria
Registered address: [Sofia, zh.k. Mladost 3, bl. 368, ent.5, fl.5 , Bulgaria]
Company identification number (EIK/UIC): 208780262
Email: customer@masonsvision.com
Website: https://masonsvision.com

Mason’s Vision operates an online jewellery store offering ready-to-order and made-to-order jewellery, including products that may be personalised or commissioned to customer specifications.

Where these Terms & Conditions refer to “Mason’s Vision”, “we”, “us” or “our”, they mean Mason’s Vision EOOD.

Where these Terms & Conditions refer to “customer”, “you” or “your”, they mean the person using the website or placing an order.

3. Eligibility and Customer Accounts

You must have the legal capacity to enter into a binding purchase contract under the laws applicable to you.

When creating an account or placing an order, you must provide accurate, complete and up-to-date information.

You are responsible for maintaining the confidentiality of your account credentials and for taking reasonable steps to prevent unauthorised access to your account.

You must notify us promptly if you become aware of unauthorised use of your account.

We may restrict, suspend or terminate access to an account where reasonably necessary to address fraud, unlawful activity, security risks, serious misuse of the website or a material breach of these Terms & Conditions. Where appropriate, we will provide an explanation and an opportunity to resolve the issue.

Any action affecting an existing order will remain subject to applicable contractual and consumer rights.

4. Products and Product Information

We aim to ensure that product descriptions, photographs, specifications, prices and customisation options are accurate and up to date.

Depending on the product, the information provided may include:
Core metal and metal purity.
   •   Stone type, colour and clarity.
   •   Plating colour and available finishes.
   •   Ring sizes, chain lengths and other dimensions.
   •   Engraving and other personalisation options.
   •   Available product configurations and manufacturing specifications.

The options available for each product are displayed on the relevant product page.

Product photographs and digital representations are intended to illustrate the jewellery. Minor variations in appearance may arise from lighting, screen settings, manufacturing tolerances or the characteristics of the materials used. Such variations do not excuse a failure to supply goods that conform to their description, agreed specifications or applicable legal requirements.

The materials and specifications applicable to your purchase are those stated on the product page, in the selected configuration and in any applicable written quotation or order confirmation.

We do not guarantee that every configuration will be available at all times. Where a selected configuration cannot be supplied, we will contact you and agree an appropriate resolution in accordance with applicable law.

5. Orders and Contract Formation

Placing an order through our website constitutes an offer to purchase the selected products under these Terms & Conditions.

An automated order acknowledgement confirms receipt of your order but does not, by itself, constitute acceptance of that offer.

A purchase contract is formed when Mason’s Vision explicitly accepts your order, ordinarily through a separate order-acceptance communication.

We may decline an order before acceptance where reasonably justified, including in circumstances involving:
   •   A genuine pricing or technical error.
   •   Suspected fraudulent or unauthorised activity
   •   A manufacturing or supply problem that prevents fulfilment.
   •   An unavailable or technically impossible product configuration.
   •   A material error in the information required to process the order.

Where we decline an order after receiving payment, we will arrange the appropriate refund without undue delay and in accordance with applicable law.

We will not rely on this section to avoid an existing contractual obligation without a lawful basis.

Once an order has been accepted, its agreed price will not be changed unilaterally merely because market prices, metal prices or our costs subsequently change.

Changes requested by the customer after acceptance may require a revised quotation or a separate agreement. No additional amount will be charged without an appropriate contractual basis and any required customer agreement.

6. Prices, Currency and Taxes

Prices are displayed in euros (EUR), unless the website expressly states otherwise.

The total price payable, applicable taxes, delivery charges and any other mandatory charges will be disclosed as required before the customer places the order.

VAT treatment: VAT tax is included in all pricing accordingly to European law

Where VAT or another tax is legally applicable, it will be handled in accordance with the applicable tax rules.

Prices may be updated for future orders. Such changes do not affect the agreed price of an order that we have already accepted.

Any additional customs duties, import taxes or charges imposed by the destination country must be disclosed or allocated in accordance with applicable law and the shipping arrangement selected for the order. We will not treat an undisclosed mandatory charge as automatically payable by the customer.

7. Payments

We intend to offer the following payment methods, subject to availability at checkout:
   •   Credit and debit cards.
   •   Apple Pay.
   •   Google Pay.
   •   PayPal.

The payment methods actually available for an order will be displayed during checkout.

Payment processing may be performed by third-party payment service providers. Their applicable terms and privacy notices may also apply to the payment transaction.

We do not intend to store complete payment card details in our customer database. The handling of payment information depends on the payment integration used.

For standard orders, payment is required according to the checkout instructions. Unless otherwise stated, standard orders must be paid in full before manufacturing or fulfilment begins.

For bespoke commissions, the payment schedule specified in the accepted quotation will apply. This may involve an initial deposit followed by payment of the remaining balance depending on the order and design of the product

Bespoke payment terms: You will receive an email with confirmation of your order, possibly accompanied by a visualization of the design and a payment link for a deposit covering the CAD design fees. This deposit will be calculated into the the final price. Following this after CAD design is finished it will be set to you for confirmation, along with a payment link for the rest of the sum.

If a payment fails, is reversed or is reasonably suspected to be unauthorised, we may suspend processing while the matter is investigated. Any cancellation or recovery of funds will be handled in accordance with applicable law and the relevant payment provider's procedures.

8. Made-to-Order Jewellery

Many Mason’s Vision products are manufactured after an order is placed rather than held in finished stock.

Manufacturing begins after the order has been accepted and any required payment or deposit has been received, subject to the applicable product or commission terms.

Production and delivery estimates are provided in good faith and may depend on material availability, manufacturing capacity, customisation requirements and international shipping arrangements.

Delivery estimates: Production time has an estimate of 2 weeks, upon finish it passes through Bulgarian Hallmarking processes in accordance EU law and is sent straight to you afterwards. If you are located outside of EU hallmarking process might be unnecessary which will significantly reduce

We will notify customers of material delays where reasonably practicable. Any delay will remain subject to applicable delivery obligations and consumer remedies.

The fact that an item is manufactured after an order is placed does not, by itself, mean that the customer loses the statutory right of withdrawal.

9. Customisation and Bespoke Commissions

Depending on the product, customers may be able to select engraving, stone characteristics, core metal, plating, sizes, chain lengths or other available specifications.

The available options and the price associated with them will be displayed on the product page or in the relevant quotation.

Customers are responsible for reviewing their selected specifications and checking that any personalisation instructions are accurate before submitting the order.

For bespoke commissions, the proposed design, specifications, price, payment schedule and estimated timeline will be set out in a written quotation or other written agreement.

Where applicable, production of a bespoke design will begin after the customer has approved the relevant design and the required deposit has been received.

Any material change requested after approval may require a revised quotation, a revised delivery estimate or additional payment agreed in advance.

We may decline a proposed design where it cannot reasonably be manufactured, would infringe third-party rights or would otherwise be unlawful.

Nothing in this section excludes statutory remedies where the delivered product fails to conform to the agreed design or contract.

10. Optional Engraving and Personalised Products

Engraving is optional unless a particular product listing expressly states otherwise.

Where engraving is offered, the customer may enter their chosen engraving text or select the explicit “No engraving” option.

Customers are responsible for ensuring that their submitted engraving text, spelling, dates, names and other personalisation instructions are correct.

A product engraved or otherwise personalised according to a customer's individual specifications may qualify for the statutory exception to the right of withdrawal for goods made to the consumer's specifications or clearly personalised.

Where that exception lawfully applies, the customer will not have the ordinary 14-day right to withdraw merely because they have changed their mind.

The exception will not be applied automatically to all made-to-order jewellery or to every product with selectable options. Its application depends on the nature of the goods and the personalisation involved.

Products purchased without engraving remain subject to the ordinary statutory withdrawal rules where applicable, unless another legal exception applies.

The personalised-goods exception does not remove statutory rights and remedies relating to defective, damaged, incorrectly engraved or otherwise non-conforming goods.

11. Cancellation of Orders and Bespoke Commissions

Before an order is accepted, the customer may withdraw their offer to purchase by contacting us, subject to any applicable legal requirements.

After a contract has been formed, cancellation is governed by these Terms & Conditions, the applicable quotation and mandatory law.

For bespoke commissions, a cancellation request made after design approval or after manufacturing has begun will be assessed in light of the work performed, materials committed, the terms of the accepted quotation and applicable legal requirements.

A deposit is not automatically non-refundable merely because it is described as a deposit or because production has begun.

Any amount retained or payable on cancellation must have a lawful contractual basis and must comply with applicable consumer protection rules. We will not impose a blanket cancellation charge that unlawfully removes a customer's statutory rights.

Where a cancellation is agreed or legally required, any refund due will be calculated and processed in accordance with the applicable agreement and law.

This section does not limit a consumer's statutory right of withdrawal where it applies, or any remedies for non-conforming goods.

12. Shipping and Delivery

We intend to ship internationally, subject to applicable country restrictions, legal requirements and the delivery options available for the order.

Depending on the order, jewellery may be shipped directly from a manufacturing supplier or fulfilment partner to the customer, or may pass through an intermediate destination before delivery.

Available delivery methods, shipping charges and estimated delivery periods will be shown at checkout or otherwise communicated before the customer is bound by the contract.

The delivery estimate applicable to an accepted order will form part of the relevant order information.

Where delivery is delayed, unavailable or materially affected by circumstances outside the originally agreed arrangement, we will handle the matter in accordance with applicable law.

Risk in the goods will pass to the customer at the time prescribed by applicable law. Where the customer arranges their own carrier independently of the options offered by us, the applicable statutory rules concerning transfer of risk will apply.

Customers should provide a complete and accurate delivery address and any contact information reasonably required to fulfil the shipment.

If delivery fails because the customer supplied an incorrect address or failed to comply with a reasonable delivery requirement, we may seek an appropriate resolution consistent with the contract and applicable law.

Shipping information to confirm: Delivery estimate is 3-4 weeks, but might take longer due to high demand of factory or hallmarking center, holidays or other events. Shipping is free, though in special occasions might be covered by the customer.

13. Customs Duties and Import Charges

International orders may be subject to customs duties, import VAT, handling charges or other destination-specific requirements.

The treatment of these charges depends on the destination, the applicable law and the shipping arrangement.

Before an order is placed, we will provide the information required by law concerning additional charges payable by the customer, to the extent those charges are known or can reasonably be calculated.

Where a charge cannot reasonably be calculated in advance, we will provide the required notice of its possible existence.

Customers are responsible for charges lawfully allocated to them and properly disclosed before purchase. Nothing in these Terms & Conditions transfers to the customer a tax or other obligation that the law places on Mason’s Vision.

Where a supplier or shipping partner arranges delivery, the actual fulfilment arrangement may affect how customs formalities and charges are handled.

14. Right of Withdrawal for Online Purchases

Where applicable law provides a statutory right of withdrawal, consumers may generally withdraw from an eligible online purchase within 14 days after receiving the goods, without giving a reason.

Special rules apply where an order contains several goods delivered separately or consists of multiple lots or pieces.

The withdrawal period and any applicable exceptions will be determined under the law governing the relevant transaction.

To exercise the right of withdrawal, the customer must communicate an unequivocal decision to withdraw within the applicable period. Where required by EU law, customers may also use the online withdrawal function made available on our website.

Online withdrawal function: [Insert the final website address or clear location of the function once implemented.]

Where a valid withdrawal is exercised, the customer must return the goods within the period required by applicable law, up to 14 days after notifying us of the withdrawal.

Unless we have agreed to bear the cost or the law requires otherwise, the customer bears the direct cost of returning the goods, provided that this obligation was disclosed before the purchase.

We will reimburse the payments required by law, including the cost of standard delivery where applicable. We are not required to reimburse additional delivery costs resulting from the customer's choice of a more expensive delivery method than the least expensive standard delivery offered.

Refunds will be made within the applicable statutory period and using the original payment method unless the customer expressly agrees otherwise without incurring fees.

Where permitted by law, we may withhold reimbursement until we have received the returned goods or the customer has supplied evidence of having sent them back, whichever occurs first.

The customer may be responsible for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods, to the extent permitted by law.

The right of withdrawal does not apply where a statutory exception lawfully excludes it, including qualifying goods made to the consumer's specifications or clearly personalised.

15. How to Exercise the Right of Withdrawal

Customers may notify Mason’s Vision of their decision to withdraw by using the online withdrawal function, where applicable, or by sending an unequivocal withdrawal statement to our published contact email.

Customers are not required to use a particular form where applicable law permits another unequivocal statement. The statutory model withdrawal form may be used where appropriate.

customer@masonsvision.com

For efficient processing, customers should provide their name, order number, the product concerned and the date of the order or delivery.

The withdrawal deadline is met where the customer sends the withdrawal communication before the applicable period expires.

Where the online withdrawal function is used, we will provide the confirmation required by Bulgarian law, including confirmation of receipt and the relevant submission details, within the applicable statutory deadline.

A withdrawal request will not be rejected solely because a customer did not use a preferred communication method where the law permits another valid method.

16. Returns of Defective, Damaged or Non-Conforming Goods

The statutory right of withdrawal is separate from a customer's rights where goods are defective, damaged, incorrectly supplied or otherwise fail to conform to the contract.

If a product is defective, does not match the agreed specifications, contains an incorrect engraving or differs materially from the accepted order, the customer should contact us with the order details and a description of the issue.

Where reasonably useful, the customer may provide photographs or other information to help identify the problem. Such information will not replace any rights available under applicable law.

We will assess the claim and provide the remedies required by applicable law, which may include repair, replacement, a price reduction or termination of the contract, depending on the circumstances and legal requirements.

Where the law requires a remedy to be provided without charge, the customer will not be required to pay the costs that the law places on the seller.

No provision of these Terms & Conditions excludes mandatory statutory rights relating to conformity, durability, safety or other legally protected consumer interests.

17. Statutory Conformity Rights and Commercial Warranties

Customers retain their statutory rights concerning the conformity of goods with the contract.

These rights are separate from any voluntary commercial warranty offered by Mason’s Vision or a manufacturer.

Additional commercial warranty: No additional voluntary commercial warranty is specified in these Terms & Conditions. Any such warranty will apply only where its existence and terms have been expressly communicated to the customer.

Nothing in this section limits any mandatory statutory guarantee, conformity remedy or other consumer right.

18. Jewellery Care and Product Use

Customers should follow any care instructions provided for the product and use the jewellery in a manner appropriate to its materials and construction.

Exposure to chemicals, abrasive products, impact, moisture, improper storage or other environmental conditions may affect jewellery, plating, surface finishes or stones.

Where care guidance is supplied, it is intended to help customers maintain their jewellery. It does not remove statutory rights or excuse a failure of the product to conform to the contract.

A claim will be assessed according to the actual circumstances, the product specifications, the evidence available and applicable law. Normal wear and tear or damage caused by improper use may be relevant to an assessment where legally appropriate.

19. Intellectual Property

Unless otherwise stated, the website's original text, photographs, graphics, branding, logos, product presentation and other protected content belong to Mason’s Vision or are used under appropriate permission.

Nothing in these Terms & Conditions grants a customer ownership of our intellectual property merely because they purchase a physical item of jewellery.

Customers may not reproduce, distribute, commercially exploit or otherwise use protected website content without the necessary permission, except where such use is permitted by law.

For commissioned designs, Mason’s Vision retains its intellectual property rights, including any applicable rights to reproduce the design, unless a separate written agreement expressly provides otherwise.

A customer's purchase of a physical commissioned item does not, by itself, transfer copyright or other intellectual property rights in the design.

Any agreed exclusive licence or transfer of rights must be set out in a separate written agreement identifying the rights concerned, their scope and any applicable conditions.

Customers must not submit engraving text, artwork, logos or other materials that unlawfully infringe another person's rights. The customer is responsible for having the necessary rights or permissions for materials they submit, subject to applicable law.

20. Website Use and Reviews

Customers must use the website lawfully and must not knowingly submit fraudulent orders, attempt unauthorised access, interfere with website security, distribute malicious software or misuse the website in a way that harms other users or our operations.

Where the website permits product reviews, customers must not submit knowingly false or deceptive reviews, impersonate other persons or publish unlawful content.

Reviews should reflect genuine experiences and must not include private information that the reviewer is not authorised to disclose.

We may moderate or remove content where reasonably necessary and lawful, including content that is unlawful, fraudulent, abusive or materially violates these Terms & Conditions.

Any moderation will be subject to applicable law. Nothing in this section permits us to suppress lawful consumer criticism merely because it is unfavourable.

21. Limitation of Liability

Nothing in these Terms & Conditions excludes or restricts liability where such exclusion or restriction is prohibited by applicable law.

In particular, these Terms & Conditions do not exclude mandatory consumer rights, statutory remedies for non-conforming goods, or liability that cannot lawfully be excluded or limited.

Subject to those limitations, Mason’s Vision is responsible for performing its contractual obligations in accordance with the applicable agreement and law.

We will not be liable for a failure or delay to the extent that it is caused by circumstances for which we are not legally responsible, provided that this does not remove any mandatory consumer remedy.

Where a claim arises, liability will be determined in accordance with the applicable contract, the circumstances of the claim and the relevant legal requirements.

Nothing in this section creates a blanket exclusion of liability for all losses or permits an unfair term to be enforced against a consumer.

22. Third-Party Providers and External Websites

Our website may rely on third-party providers for payment processing, hosting, manufacturing, fulfilment, shipping, communications or other services.

The use of a third-party provider does not automatically remove Mason’s Vision's contractual responsibilities to the customer.

Where a third party provides a separate service directly to a customer, that service may also be governed by the third party's own terms.

Links to external websites are provided for convenience. We do not control external websites and are not responsible for their content or practices, subject to any responsibilities imposed on us by applicable law.

23. Privacy and Personal Information

Personal information is processed in accordance with our Privacy Policy and applicable data protection law.

Customer information may be used as necessary to accept and fulfil orders, manufacture and deliver jewellery, process payments, provide customer support, comply with legal obligations and carry out other lawful activities disclosed in the Privacy Policy.

Where necessary for fulfilment, relevant information may be shared with payment providers, manufacturers, couriers, fulfilment partners or other service providers, subject to applicable legal requirements.

The Privacy Policy explains the categories of information processed, relevant purposes, legal bases, recipients, retention and customer rights.

24. Complaints and Dispute Resolution

Customers should first contact Mason’s Vision using the published customer-service email if they have a complaint concerning an order, delivery, product conformity, payment or other matter.

We will review complaints and seek to resolve them in a reasonable manner.

Customers retain the right to contact the competent consumer protection authority or pursue any other remedy available under applicable law.

In Bulgaria, the Commission for Consumer Protection is a relevant consumer protection authority.

Official website: https://kzp.bg/

Nothing in this section requires a consumer to give up a statutory right to bring proceedings or to use an optional alternative dispute resolution procedure where the law provides otherwise.

25. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of the Republic of Bulgaria, subject to applicable mandatory rules.

Where a customer qualifies as a consumer under the law applicable to their circumstances, this choice of law does not deprive the customer of protections that cannot lawfully be excluded by agreement, including any mandatory protections available under the law applicable to the consumer.

Any dispute will be handled by the competent courts determined under applicable law. Nothing in this section prevents a consumer from bringing proceedings before a court where mandatory law grants that right.

26. Changes to These Terms

We may update these Terms & Conditions to reflect changes in our business, products, website functionality, service providers or applicable law.

The latest version will be published on this page with its revision date.

Changes will not retroactively alter an existing accepted order unless the change is permitted by law or agreed with the customer.

Where required, we will provide additional notice or obtain the customer's agreement before a change affects an existing contractual relationship.

27. Severability

If a provision of these Terms & Conditions is found to be invalid or unenforceable, it will be applied only to the extent legally permitted or, where necessary, treated as severable from the remaining provisions.

The remaining provisions will continue to apply to the extent that doing so is consistent with applicable law.

This section does not authorise the replacement of an unfair consumer term with a provision that unlawfully prejudices the customer.

28. Entire Agreement

These Terms & Conditions, together with the accepted order, relevant product specifications, any applicable written quotation and other terms expressly incorporated into the contract, form the contractual framework for the purchase.

Where a separate written quotation governs a bespoke commission, it will apply to the matters it expressly addresses, subject to mandatory law.

Nothing in this section excludes information or representations that form part of the contract under applicable law.
